Yes. Labor Day is one of the eleven legal public holidays set out in 5 U.S.C. § 6103. Federal offices close, federal employees receive the day off with pay, and every state observes it.

There is no federal law requiring private employers to provide paid holiday leave. The Fair Labor Standards Act does not mandate paid holidays, so whether a private-sector worker is paid depends on the employer — though Labor Day is among the most widely observed paid holidays in the country.

Labor Day always falls on the first Monday in September, so its calendar date shifts each year between September 1 and September 7.

This is unlike Independence Day or Christmas Day, which are fixed to a calendar date and move to the nearest weekday when they fall on a Saturday or Sunday. Labor Day is already a Monday, so the observed-date rule never applies to it.

Because the holiday is fixed to a Monday, it always creates a three-day weekend running from Saturday through Monday. This is the reason the date carries far more cultural weight than a mid-week holiday of similar standing.

It also marks the informal end of the American summer. Most school districts have returned the week before or return the following day.

Labor Day grew out of the union-organized parades of the 1880s. The first was held in New York City on September 5, 1882, organized by the Central Labor Union, and the practice spread through state legislatures over the following decade.

Congress made it a federal holiday on June 28, 1894, in the immediate aftermath of the Pullman strike — a national railroad dispute that ended with federal troops deployed against strikers and around thirty deaths. The legislation passed within days of the strike collapsing.

Most countries mark a comparable day on May 1, known as International Workers’ Day or May Day. The United States and Canada are the notable exceptions, both observing it on the first Monday in September.

Canada’s Labour Day shares the same date and a common origin in the Toronto printers’ strike of 1872, which predates the American holiday by a decade.
