Is Columbus Day a public holiday?

Yes at federal level. Columbus Day is one of the eleven legal public holidays in 5 U.S.C. § 6103, so federal offices close and federal employees receive the day off with pay.

State observance is the most fragmented of any federal holiday. A number of states and many cities observe the same date as Indigenous Peoples’ Day, and several states do not treat it as a paid state holiday at all.

What day is Columbus Day?

Columbus Day always falls on the second Monday in October, so its calendar date moves each year between October 8 and October 14.

The date it commemorates is October 12, 1492. As with Washington’s Birthday, the Monday rule means the holiday can fall on the commemorated date only occasionally, and never reliably.

History of the holiday

The first statewide observance was in Colorado in 1907, driven largely by Italian-American communities for whom the day was a marker of recognition. President Franklin D. Roosevelt proclaimed a national observance in 1937.

Congress made it a federal holiday under the Uniform Monday Holiday Act of 1968, effective in 1971, moving it from October 12 to the second Monday in October.

Indigenous Peoples’ Day

South Dakota was the first state to replace the observance, adopting Native American Day in 1990. Berkeley, California, adopted Indigenous Peoples’ Day in 1992.

The two names now coexist on the same date in much of the country. The federal statute is unchanged, so the federal holiday remains Columbus Day even where a state or city observes a different name.
